These Terms & Conditions govern your use of the Donatello Fitness website and services. By using the site or subscribing to any plan, you agree to these terms.
1. Parties
This agreement is between you and Donatello Fitness, referred to as "we" or "the coach", and you as the user or trainee.
2. Acceptance
By using the site, creating an account, or completing a purchase, you confirm that you have read and agree to these terms. If you represent a business, you confirm that you are authorised to bind it.
3. Service description
We provide online personal training, customised workout plans, nutrition coaching, and weekly accountability through the live chat and trainee dashboard.
4. Acceptable use
You must not use the service for any unlawful, fraudulent, or harmful purpose. Specifically prohibited:
- Unlawful use of the service.
- Fraud, spam, or phishing.
- Intellectual property infringement.
- Attempting to hack systems or introduce malware.
- Scraping data or reselling the service without permission.
5. Intellectual property
All content, software, branding, and training materials on the site are owned by Donatello Fitness. We grant you a limited, non-exclusive licence to use them solely within your personal subscription plan.
6. Service level
We strive to keep the service available but do not guarantee uninterrupted or error-free performance. Maintenance or delayed responses may occur depending on the coach's schedule.
7. Payments and subscriptions
Payments are processed by our online reseller Paddle.com. Paddle handles payment processing, billing, tax, subscription management, cancellations, and refund handling. Please review Paddle's Buyer Terms for details.
8. Merchant of Record disclosure
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, fraudulent activity, or security risk. You may also cancel your subscription through Paddle.net at any time, subject to Paddle's terms.
10. Liability
We are not medical professionals. Consult a physician before starting any exercise or diet program. To the fullest extent permitted by law, we are not liable for any indirect or consequential damages. Our total liability is limited to the fees you paid in the six months preceding the claim.
11. Indemnity
You agree to indemnify Donatello Fitness against any claims arising from your unlawful use of the service or breach of these terms.
12. Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes will be resolved in its courts.
13. Changes
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
